Alan Payne appears for the successful Secretary of State in Secretary of State for the Home Department v IA (Turkey)

This week the Court of Appeal allowed the Secretary of State’s appeal against the determination of a Senior Immigration Judge that the Secretary of State’s refusal to vary IA’s leave to remain was not in accordance with the law. Sullivan LJ held, inter alia, that the decision by the Secretary of State that IA was not entitled to indefinite leave to remain was not inconsistent with an earlier determination of the Asylum and Immigration Tribunal that IA was, by virtue of Article 3, a refugee. The decision furnishes immigration practitioners with welcome guidance on the circumstances in which TB(Jamaica) applies.
